من الثوابت والمسلمات في الشريعة الإسلامية الإعتقاد بأن الله تعالى هو الوحيد الذي له حق التشريع والحكم، وله أن يتصرف في جميع شؤون خلقه: "إن الحكم إلا لله يقصّ الحق وهو خير الفاصلين، وبالتالي، فإن الأصل في مبدأ الولاية والسلطة والحاكمية هو لله وحده، وعلى هذا الأساس فليس لأي فرد من أفراد المجتمع أن يشرع من نفسه مطلقاً، وإنما هو منفذ لأوامر الله تعالى. يقول أمير المؤمنين علي (رضي الله عنه) في هذا المجال: "أيها الناس إن آدم لم يلد عبداً ولا أمة، وإن الناس كلهم أحرار، ولكن الله خوّل بعضكم بعضاً"، فلا شرعية لسلطة أي فرد على آخر.
من هنا اكتسب البحث في شكل الحكم ومضمونه في الإسلام أهمية خاصة، وخصوصا ما ظهر فيه من وجهات نظر متفاوتة، فكان هذا البحث الذي قسّمه مؤلفه السيد "محمود الوزيري" إلى ثلاثة أبواب. في الباب الأول تم استعراض الأصول النظرية والتطبيقية لأطروحة نظام الحكم في الإسلام مبيناً الأصول النظرية لفلسفة الحكم في الإسلام، وشمولية الدين وولاية الأمر ثم نظام الحكم والإدارة في عهد الرسول (ص) وبعده، وناقش نظرية الشورى، ثم الباب الثاني وتم التعرض فيه إلى الركائز الأساسية للسلطة الإدارية في الإسلام ومنها أركان السلطة التشريعية والتنفيذية والقضائية. وكذلك ناقش نظام الحكم في الإسلام وفق مدرسة أهل البيت وفيه تم التعرض لماهية هذا الحكم كما تجلت في التاريخ الإسلامي، إضافة إلى خصائص القيادة في الإسلام، ونظرية الحكم والإدارة في الجمهورية الإيرانية.
