لم يعرف هذا المصطلح: "حقوق الإنسان" عند علماء المسلمين قديماً، كإسم لعلم خاص تبحث فيه القضايا والأفكار التي تدور حول كرامة الإنسان، والاعتناء به والدفاع عنه، كإنسان بصرف النظر عن دينه، وجنسه ولونه. وكان علماء الفقه قديماً يبحثون ما يخص الإنسان من أحكام في مواضع متفرقة من أبواب الفقه.
وإنما يبرز هذا المصطلح: "حقوق الإنسان" في العصور الحديثة عندما استيقظت أوروبا من نومها العميق وغفلتها في عصور الظلمة، ورأت ما يتعرض له الإنسان في بلادها من ظلم وعسف وقهر على أيدي الحكام تارة، وعلى أيدي الإقطاعيين والرأسماليين ورجال الدين تارة أخرى، واحتج هذا كله حفيظة الشعوب، وأثار ثائرة أولئك المقهورين.
وبرز بينهم من يرفع الصوت عالياً بأسمائهم، وينادي بحقوقهم، وقام الباحثون يضعون لهم الأطر النظرية والفكرية لمعالم حقوقهم، والمبررات العلمية لثوراتهم والتنفيس عن آلامهم وأحقادهم، وتشكلت الجماعات، وقامت الثورات، وكان من أبرزها الثورات الأميركية التي أفرزت إعلان حقوق الإنسان عام 1776م. هذا، ولم يكن العالم الإسلامي، يعيش ذلك التناقض، ولا يعاني غياب تلك المبادئ والحقوق التي تضمن كرامته، وتصون حريته، لأن الإسلام يوم جاء بالمبادئ والأصول التي ترسم المعالم الواضحة لبيان ما لكل إنسان وما عليه من التزامات، وحقوق وتعبد السبل لحياة كريمة لا ظلم فيها ولا مظلوم.
وما في هذا الكتاب ليس إلا بحثاً موجزاً موضوعه حقوق الإنسان على ضوء الكتاب والسنة"، والهدف منه اطلاع القرّاء والباحثين على الحقوق الإنسانية التي جاء بها الإسلام لضمان حرية وكرامة أبناءه وبالرجوع لمضمون الدراسة نجد أنها تنقسم على مقدمة، وخمسة مباحث وخاتمة. أما المقدمة فتحتوي على ذكر تعريف للإنسان ولحقوقه ولمنشأ هذه الحقوق ومصادرها، ولمكانة هذا الإنسان في نظر الدين. أما في المباحث فجاء تناول لطائفة من هذه الحقوق في ضوء الكتاب والسنة، وأحكام الشرع الإسلامي الحنيف، وهذه الحقوق هي حق الحياة، حق العلم، حق التملك، حق المساواة.، وحق الحرية.
أما الخاتمة فانطوت على تقويم عام لرعاية الإسلام لمصالح العباد، والأثر السيء للإعراض عن هذا الإسلام، وهجر شرائعه، وعدم تطبيق مبادئه.
