إذا كان علم الإحتساب - كما قرر الإمام حاجي خليفة- ينبغي أن يتلازم مع الواقع العملي من حيث الأشخاص والأزمان والأحوال إلا أن دراسته في عصرنا باعدت بيه وبين ذلك الواقع العملي سواء في كليات الشريعة والقانون في جامعة الأزهر أو في كليات الحقوق بمصر.
وهكذا تظهر الصعوبات أمام الباحث المعاصر حيث يتعين عليه في سبيل الوصول غلى معرفة القواعد التى يستند إليها نظام الحسبة أن يتلمس تلك القواعد في فروع القمانون لوضعي المختلفة كما يتعين عليه إثبات مشروعية دعاوى الحسبة في نطاق المعاملات المدنية والتجارة وأهميتها قبل بيان قواعد الاجراءات الخاصة بها. وفي هذا الكتاب نقسم هذا البحث إلى سبعة أبواب وخاتمة: الباب الاول : التعريف بالحسبة وبيان مشروعيتها وطبيعتها ومكانتها في الإسلام الباب الثاني : كيف كانت الحسبة في الزمن الماضي الباب الثالث: أركان الحسبة الباب الرابع: صلة القضاء بالحسبة. الباب الخامس: دعوى الحسبة في ظل القانون الوضعي المصري رقم (3) لسنة 1996 بشان تنظيم إجراءات مبائرة دعوى الحسبة بشأن مسائل الأحوال الشخصية. الباب السادس : إجراءات دعوى الحسبة. الباب السابع: والاخير : نظر دعوى الحسبة ، وحجية الأحكام الصادرة فيها وتنفيذها.
