Book Description
يُعد كتاب "الموافقات في أصول الشريعة" من أهم كتب الأصول، فقد أودع فيه مؤلفه ما اهتدى إليه من أسرار التكاليف المتعلقة بالشريعة الحنفية، وسمّاه أولاً "عنوان التعريف بأسرار التكليف" ثم عدل عن هذه التسمية وسمّاه "الموافقات" مبتكراً لذلك قصة عزا فيها الإحياء بتسميته إلى رؤيا رآها أحد شيوخه.
والكتاب مقسم من حيث موضوعاته إلى خمسة أقسام: أولاً المقدمات: وعددها ثلاث عشرة مقدمة، جعلها الشاطبي تمهيداً لمباحث كتابه، حيث ضمنها المبادئ العامة التي يحتاج إليها في فهم مباحث الكتاب. ثانياً الأحكام: وتناول في هذا القسم الأحكام الخمسة التكليفية والأحكام الخمسة الوضعية، بحيث أحاط بالأحكام كلها مبيناً ارتباطها بمقاصد الشريعة من تحقيق للمصالح ودرءٍ للمفاسد،ثالثاً: المقاصد: وقد قسمها الشاطبي إلى أربعة أنواع، فصل كل نوع منها إلى فصولاً ومسائل، فسماها" "مقاصد الشارع" ومقاصد المكلف.
وجملة مباحث علم المقاصد تسعة وأربعون مبحثاً واثنتان وستون فصلً فصّل فيها الشاطبي نظريته التي تتلخص في أن الشريعة نظام شامل لإطلاع الإنسان. رابعاً: الأدلة: وقد اقتصر الشاطبي منها على دليلين، وهما الكتاب والسنة. فتناول كل ما يتعلق بالكتاب والسنة من الموضوعات والمسائل مبيناً عوارضهما من الأحكام والتشابه والنسخ والأمر والنهي والعموم والخصوص...
ثم انتقل إلى أحكام العلوم المضافة إلى القرآن الكريم وبين ما يحتاج إليه المجتهد منها في الاستنباط، كما تناول مسائل متفرقة تتعلق بالقرآن أيضاً. خامساً: الاجتهاد: والتعليل: وتتعلق الجوانب التي بحثها الشاطي في هذا القسم والأخير من كتابه، كما يقول هو بأحكام الاجتهاد والتعليد والمتصفين بكل واحد منهما، وما يتعلق بذلك من التعارض والترجيح والسؤال والجواب.
هذا، وتجدر الإشارة إلى أن الشاطبي كان أول من نادى باعتماد مقاصد الشريعة في الإجتهاد، لأن فهم ما انبنت عليه تلك المقاصد في تحقيق المصالح واستبعاد المفاسد كفيل بإدراك الأحكام المحققة لهذه الغايات العليا للشارع من وراء وصفه للتشريع.
