كتبانا الحالى سنخصصه لشرح "العقوبات التأديبية" التى يجوز توقيعها على العاملين اذا ما اقترفوا مخالفة أو جريمة تستوجب ذلك، وسنبدأ هذا الكتاب، بتعريف العقوبة التأديبية، وبيان الهدف الذى تغياه المشرع منها، ومدى اختلافها أو ائتلافها مع العقوبة الجنائية، ثم نتحدث عن المبادئ العامة التى تقوم عليها العقوبات التأديبية ومن أهم هذه المبادئ، شرعية العقوبة، وعدم ازدواجها عن الفعل الواحد، وأن تكون شخصية، أى لا تنال الا الموظف المسئول عن المخالفة، ولا تزر وازرة وزر أخرى. كما يجب أن تكون العقوبة ملائمة وعادلة، دون ما افراط فى الرأفة، أو اسراف فى القسوة، ثم نعرض لبعض تقسيمات هذه العقوبات. ذلك أنها تقسم الى عقوبات أصلية وعقوبات تبعية، كما تقسم الى عقوبات صريحة وعقوبات مقنعة، والى عقوبات أثناء الخدمة وأخرى توقع بعد انتهاء هذه الخدمة، ثم نستظهر قوائم تلك العقوبات وتطورها.
ثم نتحدث عن العقوبات التأديبية المقنعة، وهى التى تلجأ اليها الجهات الادارية تحت ستار اجراء ادارى تستهدف به التنكيل بالعامل، ونتناول، بعد ذلك، العزل أو انتهاء الخدمة بقوة القانون، كأثر لحكم جنائى. وسنرى أن لهذا الاجراء، ضوابطه وحالاته المقررة فى قانون العقوبات، ثم نعرض لأسباب انقضاء العقوبة التأديبية، كسحب هذه العقوبة اداريا، أو الغائها قضائيا. وهل تنتهى بمضى المدة، أو بوفاة العامل، أو العفو، أو برد الاعتبار، ونقفى بالحديث -فى باب خاص- عن الفصل بغير الطريق التأديبى، وأسبابه وحالاته وضماناته، قبل العمل بالقانون رقم 10 لسنة 1972 وبعده، وآثار الفصل بهذا الطريق.
من أجل ذلك، سنقسم هذا الكتاب، الى أحد عشر بابا، على النحو التالى: الباب الأول، تعريف العقوبة التأديبية، ومقارنتها بالعقوبة الجنائية، الباب الثانى، المبادئ العامة التى يقوم عليها الجزاء التأديبى، الباب الثالث، بعض تقسيمات الجزاءات التأديبية، الباب الرابع، قوائم الجزاءات التأديبية، وتطورها، وفقا للتشريعات التى وردت بها، الباب الخامس، العقوبات التأديبية المقنعة، الباب السادس، العزل، أو انتهاء الخدمة، بقوة القانون، كأثر لحكم جنائى، الباب السابع، انتهاء الخدمة، بغير الطريق التأديبى، الباب الثامن، شرح بعض العقوبات التأديبية، الباب التاسع، تنفيذ العقوبات التأديبية، الباب العاشرن آثار العقوبات التأديبية، الباب الحادى عشر، أسباب انقضاء العقوبة التأديبية.
