قد اختارنا هذا البحث "دور السكوت فى التصرفات القانونية"، وقد حدا بنا إلى اختيار الموضوع ما لمسناه من حاجة المكتبة العربية الماسة، إلى بحث يتضمن توضيحاً وبياناً لهذا الموضوع، بعد أن مضى على صدور القانون المدنى المصرى الحالى اكثر من ثلاثين عاماً.
من أجل هذا، فإننا سنتناول دراسة الموضوع، واضعين نصب أعيننا ضرورة بيان مكانة السكوت بين طرق التعبير عن الإرادة، ثم نعرض لحقيقته، مضمونه، حالاته وما قد يشتبه به من أنظمة أخرى، ودوره فى إنشاء التصرفات القانونية وفى تعديلها وفى تنفيذها وفى إنهائها، ثم نعرض لبعض تطبيقاته فى الشريعه الإسلامية وفى القانون المدنى.
إننا نتجه إلى الله العلى القدير أن يمنحنا القوة، وأن يوقفنا فى عملنا وأن يلهمنا الصواب، ويهدينا سواء السبيل، إنه نعم المولى ونعم النصير.

القسم الأول: الباب الأول - حقيقة السكوت: التعريف بالسكوت ومكانته بين طرق التعبير عن الإرادة وحالاته، الباب الثانى - السكوت وتكوين التصرف القانونى، الباب الثالث - السكوت وتعديل التصرف القانونى وتنفيذه وإنهاؤه.
القسم الثانى: بعض تطبيقات السكوت.
