قبل الدخول في التفاصيل تحسن الإشارة إلي نقطتين: النقطة الأولي: أن هذه الدراسة ليست في الفقه، بل في الفكر التربوي لأحد أئمة الفقه الظاهري، والنقطة الثانية: أن هذه الدراسة لا تتبنى وجهة نظر الفقه الظاهري، بل لا تناقش صحة قضاياه، من هنا تبدأ وتنتهى تاركة الحكم علي المذهب للمتخصصين من المؤيدين والمعارضين.
وعلي هذا تقع الدراسة التي بين يديك في ثلاثة فصول: الفصل الأول يعالج ابن حزم وعصره مركزاً علي أنه كان أندلساً مصغراً، والأندلس كانت ابن حزم مكبراً!! ثم يعالج بقية الفصل أسرته ومولده نشأته وثقافته، انتاجه وجهوده، وانحساره ووفاته.
الفصل الثاني: ويركز علي المنهج الظاهري بصفة عامة، والحزمى بصفة خاصة متناولاً اختلافه عن منهج المذاهب الأربعة، وتراجعه بالمشرق، ثم تألقه بالمغرب والأندلس، وصراع السلطة مع الفقهاء، واختلاف ابن حزم عن شيخه أبي داود، وأخيراً الظاهرية بعد ابن حزم.
الفصل الثالث: ويركز علي الفكر التربوي والنفسي لابن حزم متناولاً جهود التعليم في الأندلس ورأيه فيها، وصلة هذا الفكر ببيئته الإجتماعية والمادية، وأهداف العلوم عنده، ومراحل التعليم، وتصنيف العلوم.
هذه الملامح العامة للدراسة قد يخفف من هناتها وهفواتها أنها تركز علي الفكر التربوي لمفكر متعدد المواهب موسوعى الاتجاه إلا أنه لم يتخصص في التعليم والتربية، ومن ثم كان علي أن أبحث عن ملامح فكره التربوي وسط انتاج ضخم ومؤلفات متعددة.
