لم يكن لهذا العمل إلا أن يتم في قالب مقارن بحكم طبيعته، فهو موضوع تتجاذبه طائفتين من الأفكار: الطائفة الأولي تتعلق بموقف التشريعات الوطنية من أعمال قواعد القانون الدولي الإنساني والطائفة الثانية تتمثل في الجهود الدولية لإنشاء آلية دولية للمعاقبة علي جرائم القانون الدولي الإنساني وهاتين الطائفتين قد خصصنا لهما القسم الثاني من رسالتنا والمعنون بآليات الملاحقة الوطنية والدولية لجرائم القانون الدولي الإنساني. ومن خلال هذا القسم سوف نستظهر منهج التجريم الذي اتبعه القانون المصري سواء في قانون العقوبات العام أو في قانون العقوبات العسكري للمعاقبة علي الانتهاكات دولية الأثر وإذا ما استبان لنا قصور ما اتبعه المشرع المصري من منهج توجب علينا البحث في التعديلات المقترحة من أجل تفعيل قدرة المشرع المصري علي المواجهة.
ولا يمكن أن تتضح لنا معالم هذا العمل من دون العبورمن خلال قسم أول نستوضح فيه موضوع الحماية الجنائية في جرائم القانون الدولي الإنساني، والذي بانتهاكه تتأتى الملاحقة موضوع القسم الثاني؛ وفي هذا القسم الأول سوف نفرد تفصيل للفئات المشمولة بحماية القانون الدولي الإنساني في شقه الجنائي سواء أكانت تلك الحماية عامة أو خاصة.
ونحسب أن هذا العمل لن تتكامل أركانه إلا إذا ما عرجنا من خلال فصل تمهيدي نستعرض فيه بعض العموميات حول هذا الفرع الذي أطل برأسه علينا في السنوات الأخيرة والمسمى بالقانون الدولي الإنساني وخاصة الشق الجنائي منه.
وعلي هذا النحو فإن خطتنا حول هذا العمل سوف تتخذ هيكلاً ثنائياً في قسمين نمهد لهما بفصل تمهيدي علي النحو التالي:- فصل تمهيدي: عموميات حول القانون الجنائي الدولي الإنساني.
القسم الأول: موضوع الحماية الجنائية في جرائم القانون الدولي الإنساني، "الفئات المشمولة بحماية القانون الجنائي الدولي الإنساني المجني عليهم المحتملين، التجريم في مجال القانون الجنائي الدولي الإنساني"
القسم الثاني: آليات الملاحقة الوطنية والدولية لجرائم القانون الدولي الإنساني، "آليات الملاحقة علي المستوى الوطني، آليات الملاحقة علي المستوى الدولي".
نظام روما الأساسي للمحكمة الجنائية الدولية.
