يعدّ الفقه الجنائي الإسلامي الذي تطور منذ فجر الإسلام إلى أن أصبحت الشريعة الإسلامية قانوناً ثابتاً كاملاً لتنظم الأفراد والجماعات وليحكم معاملاته، والشريعة الإسلامية بلغت من الروعة والكمال حدا يعجز عن تصوره الإنسان، حيث ضمنت ضروريات حقوق الإنسان الخمسة وهي: الدين والنفس والعقل والعرض والمال بغض النظر عن لونه ودينه وجنسه، فالشرعية تتمثل في قدرة الخالق وكماله وعظمته وأمر أن لا تغيير ولا تبديل؛ لأنها ليست بحاجة للتغيير والتبديل مهما تغيرت الأوطان والأزمان وتطور الإنسان، أما القوانين الوضعية فهي: عبارة عن قواعد تصنعها الجماعة لتنظيم شؤونها وسد حاجتها، وتتفق الشريعة الإسلامية مع القانون في أن كليهما وضعاً لتنظيم الجماعة، ولكن الشريعة على سبيل الدوام وقواعدها دائمة لا تقبل التغيير.
من هنا جاء هذا البحث في الفقه الجنائي الإسلامي المقارن، فقد وقف الكاتب على عتبة عقوبة التعزيز وطرق إستيفائها، لأنه يحمل بين ثناياه الكثير من النظم والمبادئ السائدة في التشريعات الجنائية الجديدة ولأنه جزء من تراث الأمة الإسلامية وجزء من الفقه الجنائي الإسلامي؛ كما هو دراسة تاريخية - قانونية مقارنة مع القانون الوضعي؛ وقد اعتمد فيه الكاتب أسلوب المقارنة قدر المستطاع وبشكل خاص مع قانون العقوبات العراقي رقم (111) لسنة 1969.
