Book Description
يختص هذا الكتاب بذكر علم من علوم الشريعة الإسلامية غاية في الأهمية؛ ألا وهو الناسخ والمنسوخ من حديث رسول الله صلى الله عليه وسلم، إذ هو علمٌ جليل، ذو غَورٍ وغموض، دارت فيه الرؤوس، وتاهت في الكشف عن مكنونه النفوس، ولا يتم عِلم عالم دون معرفة به، فهو من تتمات الاجتهاد؛ إذ الركن الأعظم في باب الاجتهاد معرفة النقل، ومن فوائد النقل معرفة الناسخ والمنسوخ، إذ الخطب في ظواهر الأخبار يسير، وتجشم كلفها غير عسير، وإنما الإشكال في كيفية استنباط الأحكام من خفايا النصوص، ومن التحقيق فيها معرفة أول الأمرين وآخرهما.
مَرّ الإمامُ عليّ على قاصٍّ فقال: أتعرف الناسخ من المنسوخ؟ قال: لا. قال: هلكت وأهلكت.
وقال الزّهري: وقد أعيى الفقهاءَ وأعجزَهُم أن يعرفوا ناسخَ حديثِ رسول الله صلى الله عليه وسلم من مَنسُوخه.
ولم يأتِ أحدٌ بعد الزّهري تصدّى لهذا الفنِّ ولخّصه، وأمعن فيه وخصّصه، إلا ما يوجد من بعض الإيماء والإشارة في عرض الكلام عن آحاد الأئمة، حتى جاء أبو عبد الله محمد بن إدريس الشافعي رضي الله عنه؛ فإنه خاض تياره، وكشف أسراره، واستنبط معينه، واستخرج دفينه، واستفتح بابه، ورتب أبوابه.
قال أحمد بن حنبل: ما عرفنا المجمل من المفسر، ولا ناسخ حديث رسول الله صلى الله عليه وسلم من منسوخه حتى جالسنا الشافعي.
وهذا الكتاب من الكتب القليلة المختصة في هذا الفن، وقد رتبه مؤلفه على الأبواب الفقهية ليسهل على الباحث مراجعة مسائله، فجاء كتاباً نافعاً في بابه، وافياً بمراده، سهل التناول، كثير التداول.
أما مؤلفه فهو: الإمام الحافظ البارع المتقن النسابة زين الدين أبو بكر محمد بن موسى بن عثمان بن حازم الحازمي الهَمَذانيّ (548-584ﻫ)، أصله من همذان، ووفاته ببغداد.
