كثيرا ما يعرض الدفاع امام محكمة الموضوع دفعا بإنعدام رابطة أو علاقة السببية بين الخطأ والضرر والنتيجة. وكثيرا ما يبدى هذا الدفع في الجرائم غير العمدية كالقتل والاصابة الخطأ، سواء في حوادث السيارات أو سقوط المنازل بإهمال الملاك والمقاولين. ولكن الأمر يستيطل إلى أبعد من ذلك حيث الجرائم العمدية ذات النتيجة كالقتل والضرب العمدي فنشاط الجاني يؤدي إلى نتيجة مقصودة وهى إذهاق الروح بالفعل أو احداث الجروح ، سواء أدت إلى الوفاه من عدمه. وعلاقة السببية في هذه الجرائم عنصر ضروري في الركن المادي حيث يجب أن يثبت قاضي الموضوع من وجوده من تلقاء نفسه. وكثيرا ما تنتفي علاقة السببية لوجود ظروف خارجية او عناصر أجنبية يعزى اليها الضرر فتقطع علاقة السببية بين النشاط والنتيجة، ولكن ليست كل ا لظروف على قدم المساواة ، فلا يؤخذ بالظروف التى توقعها المتهم أو كان في امكانه توقعها ، ولكن الظروف الشاذة غير المؤلوفة للشخص العادى هى التى تنفي علاقة السببية . من أجل كل ذلك رأيت دراسة الموضوعية بصفة عملية تساعد الباحث في الوصول إلى الجزئية التى يبغيها.
