البحث الذي بين يديك أيها القارئ الكريم هو لبنة من لبنات كيان الأحوال الشخصية، إذ هو يتناول واحدة من المسائل التي شغلت بال كثيرين قديماً وحديثاً وهي مسألة "تحديد السن في الزواج شرعاً وقانوناً"، فمنذ صدور قانون العائلة العثماني في سنة 1917م والناس يتكلمون في هذه المسألة، ولا يزالون، فهي الآن واحدة من القضايا الهامة لدى الفكر الدولي الذي يرى أن الأمومة في سن مبكرة تؤدي إلى أضرار صحية ومخاطر اجتماعية.
والواقع أن قوانين الأحوال الشخصية في أكثر البلاد الإسلامية قد استجابت لهذه النداءات، وكان من بينها قانون الأحوال الشخصية العماني، ولما كان هذا القانون هو تقنين لأحكام شرعية كان من الضروري أن أبين موقف الفقهاء في هذا الصدد ثم اتبعه ببيان موقف القانون، وقد اقتضت طبيعة البحث أن أقسمه إلى مقدمة ومبحثين الأول في موقف الفقهاء والثاني لموقف القانون، ثم خاتمة.
