إن العلاقة العضوية بين فقه الفقيه (الشوكانى)، وفقه السلطة (القاسمية) تكاد تكون غامضة ومجهولة بالنسبة لنا، التى لا نعرف عنها سوى نتف مبعثرة بين سطور كتب السير والتراجم، التى تميل إلى إضفاء مجد ثقافى للماضى بكل تعبيراته السياسية والإجتماعية والثقافية، وبما يحمله من انقسامات فئوية وصراعات مذهبية حادة. إزاء ذلك لم يبق أمامنا سوى خيارين: إما أن ندرس كل شىء يتعلق بالشوكانى كفقيه ومحدث ومفسر زمؤرخ وشاعر مصقع، فنضيف حاشية أو شرحاً مثقلاً بالهوامش والتعليقات، أو نبدأ من حيث انتهت مقالاتها بإثارة سؤال مركب، ربما يكون فى نظر الكثير من هؤلاء الباحثين خروجاً عن المألوف: هل كان الشوكانى بالفعل عالماً مجتهداً، أم مقلداً كما يطرح خصومه من الهادوية؟ وهل كان مصيباً فى قبوله منصب القضاء الأكبر والوزارة فى وسط عهد الدولة القاسمية؟
