تكمن أهمية موضوع الدراسة فى أنه يجمع بين عدة علوم كالجغرافيا وعلم الاجتماع وعلم الأنثربولوجيا, كذلك قلة ماهو مكتوب عن القضاء العشائرى فلسطين, من ناحية أخرى لأنه من العلوم المتوارثة عن الآباء غير المكتوبة, والخوف من ضياع هذا التراث العريق, وتتمثل حدود الدراسة فى مدن الجنوب الفلسطينى التى أخذت بمبدأ القضاء العشائرى وتقع بين دائرتى عرض (29.5-31.5) شمالا وبين خطى طول (34.15-35.40) درجة شرقا, أما أسلوب الدراسة فهو الاعتماد على المنهج التاريخى من خلال تسلسل الأحداث لهذا القضاء وفقا للترتيب التالى: الفصل الأول: يوضح الجنوب الفلسطينى من حيث موقعه الجغرافى, وأهم المدن فيه, ومعجم ألفاظ عربان النقب. والفصل الثانى يتكلم عن المجتمع القبلى فى العصر الجاهلى ببلاد العرب موضحا الموقع الجغرافى, والجاهلية, والقبلية قى القبيلة, والآثار الإيجابية والسلبية لها. أما الفصل الثالث الحروب فى الجاهلية, والقضاء ونماذج من القوانين العرفية, والعرف فى القضاء الإسلامي. والفصل الرابع يعرض القضاء العشائري عند عربان النقب وما جاوراها, وديار الفصل فى النزاع.
كما يعرض الفصل الخامس مراحل القضاء وإجراءاته, والفصل السادس خصص لرجال لجان الإصلاح ودورهم فى القضاء العشائرى فى جنوب فلسطين مع عرض نماذج لبعض القضايا التى استطاعوا حلها والتغلب عليها. ويبين الفصل السابع القضايا التى يفصل فيها العشائري فى جنوب فلسطين, وأحكامها.
أما الفص الثامن فيقارن بين القضاء فى الجاهلية والقضاء فى الإسلام مع التعرض إلى مشاهير القضاء فى الإسلام ثم القصاص فى النفس, ومادون النفس. والفصل التاسع يبين الديات فى الإسلام فى القضايا التى ذكرت فى الفصل الثامن. ويبين الفصل العاشر الدعوة الصحيحة, واليمين, والبينة وكتاب القاضي للقاضي, والشهادات والإقرار, والاجتهاد فى المسائل الشرعية. أما الفصل الحادى عشر فيتضمن خاتمة البحث من حيث الاستنتاج والمقترحات والتوصيات, والمراجع.
