Book Description
حالة الضرورة فيها مشقة بالغة وحرج شديد، ومن ثم فقد عالجتها الشريعة الإسلامية فى ضوء أصل رفع الحرج، فشرعت لها من الحكام ما تندفع به كما سنبينه فى هذا الكتاب بمشيئة الله تعالى وعونه، هذا وقد قسمت هذا البحث إلى خمسة فصول يسبقهما تمهيد وتعقبهما خاتمة. أما التمهيد فقد اشتمل على مبحثين. المبحث الأول: فى تعريف الضرورة فى اللغة وفى اصطلاح الفقهاء الشرعيين، أما المبحث الثانى: فقد جاء فى تعريف الضرورة عند فقهاء القانون الوضعى أعقبتهما مقارنة بين التعريفين. أما الفصل الأول فهو فى تعليل حالة الإعفاء من الضرورة فى كل من الشريعة والقانون واشتمل هلى مبحثين. المبحث الأول فى تعليل حالة الإعفاء من الضرورة فى الشريعة الإسلامية. أما المبحث الثانى فجاء فى تعليل حالة الإعفاء من الضرورة فى القانون ثم أعقب ذلك المقارنة بينهما. أما الفصل الثانى فكان فى بيان الطبيعة الشرعية والقانونية لجرائم الضرورة وفيه مبحثان. المبحث الأول فى بيان الطبيعة الشرعية لجرائم الضرورة، والمبحث الثانى فى بيان الطبيعة القانونية لجرائم الضرورة ثم المقارنة بين الطبيعتين.
أما الفصل الثالث فكان فى شروط حالة الضرورة فى كل من الفقه الإسلامى والقانون وفيه مبحثان. المبحث الأول فى شروط حالة الضرورة فى الشريعة الإسلامية والمبحث الثانى فى شروط حالة الضرورة فى القانون ثم جاءت المقارنة بينهما. أما الفصل الرابع فكان فى نماذج وتطبيقات لحالات الضرورة فى الشريعة الإسلامية والقانون الوضعى واشتمل على سبعة مباحث. المبحث الأول: فى الاضطرار إلى القول الباطل. والمبحث الثانى فى الاضطرار إلى تناول المحظور من مطعوم او مشروب. أما المبحث الثالث فهو فى الاضطرار إلى مباشرة المحظور من الأدوية وغيرها فى حالة المرض. أما المبحث الرابع: فجاء فى الاضطرار إلى اتلاف النفس والمبحث الخامس فى الاضطرار إلى ارتكاب الفاحشة، والمبحث السادس فى الاضطرار إلى أخذ المال أو اتلافه لصاحبه، أما المبحث السابع فكان فى النماذج والأمثلة التى أوردها فقهاء القانون على حالات الضرورة. ثم أعقب ذلك المقارنة بين الشريعة الإسلامية والقانون، أما الفصل الخامس فكان فى الفرق بين حالة الضرورة وغيرها من الحلات المشابهة وفيه سبعة مباحث، وأخيراً تأتى الخاتمة وفيها أهم ما انتهى إليه البحث من نتائج.
