فيما يتصل برقابة الملاءمة فيالقضاء الدستوري فهي من الموضوعات الهامة والصعبة التناول في نفس الوقت، حيث ظل الفقه الدستوري السائد يردد بأن الرقابة القضائية منذ نشأتها الأولى، وعبر مراحلها وتطورها التاريخي، رقابة مشروعية وليست رقابة ملاءمة، ولذلك قيل إن اصطلاح الرقابة القضائية على الملاءمة اصطلاح يتناقض مع نفسه، إذ كيف توصف هذه الرقابة بأنها قضائية في الوقت الذي تمتد فيه إلى اعتبارات أخرى غير اعتبارات القانون، وكيف يمكن للقاضي الدستوري، وهو رجل قانون،أن يزج بنفسه في مسائل الملاءمة، ليحل بذلك محل المشرع، فيما حرص الدستور على أن يتركه لمطلق سلطته التقديرية، وتكمن أهمية دراسة هذا الموضوع أيضًا في الإجابة عن سؤال هام: هل توجد رقابة ملاءمة في القضاء الدستوري المقارن؟ وما دور تلك الرقابة في النظم السياسية المعاصرة؟ حيث إن الدراسات السابقة في هذا الموضوع نادرة وتتناول الموضوع بصورة جزئية ومتفرقة، ولم تقتصر تلك الدراسة لرقابة الملاءمة في القضاء الدستوري في صورتها النظرية فقط، بل في صورتها العملية والواقعية وهو ما يجعل هذه الدراسة تعد من الدراسات المشتركة بين القانون الدستوري والنظم السياسية.
وفيما يتعلق بمنهج الدراسة الذي سنتبعه فقد اتخذت المنهج التاريخي والمنهج التحليلي المقارن طريقًا للدراسة، وقد آليت على نفسي الخوض في تناول التجربة الأمريكية والفرنسية باعتبارهما مدرستين قانونيتين مختلفتين، وعلى ضوء الاعتبارات السابقة، فقد قسمنا دراستنا لرقابة الملاءمة في القضاء الدستوري إلى ما يلي: فصل تمهيدي: ماهية رقابة الملاءمة ونظرة تاريخية عن نشأة الرقابة على دستورية القوانين، الباب الأول: الأسس العامة للرقابة على دستورية القوانين، الباب الثاني: رقابة ملاءمة القوانين في الأنظمة الدستورية المقارنة، الباب الثالث: رقابة الملاءمة في قضاء المحكمة الدستورية العليا في مصر.
