هذا الكتاب هو المجلد الأول من مشروع كبير في فقه التربية للتنظيرللفكرة على مستوى المبادئ النظرية والكلّيات حيث عالج المؤلف في أبحاث عدة مفصلة مفهوم التربية وفصل ما بينه وبين غيره من المفاهيم، حيث تراوحت موضوعه ما بين أربعة فصول وخلاصاتها وأربعة ملاحق. وتمحور الفصل الأول حول: الفقه، تعريفه وموضوعه (أي فعل المكلَّفين وسلوكهم)، ومحمول الفقه والقانون (أي العلم الرديف للفقه، وتمحور الفصل الثاني حول التربية، وتعريفها وأقسامها ونظامها، إلى التربية والمفاهيم المشابِهة، وعلْم التربية، إضافة إلى علم التربية والعلوم المشابهة، والفصل الثالث يدور حول: علما الفقه والتربية: تعاملهما ومقارنتهما. والفصل الرابع يتناول فقه التربية وإمكانية استحداث هذا الفقه وضرورته، وتاريخه وإرهاصاته والعناصر الأصليّة لهذا العلم، وتوسُّع دائرته، ومكانته، ومقارنته بالعلوم المناظِرة له. وتمحورت الملاحق حول الأمور التالية: العلاقة بين الفقه والأخلاق، وولادة فقه الأخلاق وتاريخ فقه الأخلاق في المصادر الفقهية، وتاريخ فقه العقيدة في المصادر الفقهيّة، إضافة إلى مجموعة من المسائل التربوية المستحدثة.
