تحظى الرابطة الزوجية باهتمام المشرعين بغض النظر عن أسلوب معالجة المشرع لها، إذ أن رصانة المجتمع وتماسكه مرتبط ارتباطاً وثيقاً برصانتها، ولما كانت تلك الرابطة قد تم استهدافها كبقية جوانب الحياة المهمة تسارعت الثقافات الغربية والشرقية في بث سموم ثقافاتها في جزئيات الحاية الزوجية وتفاصيلها من خلال خلط المفاهيم لإشاعة المحرم المجرم وتحريم المشروع المباح فضلاً عن المطالبة بالتدخل في أخص خصوصيات الرابطة الزوجية تحت شعارات حق يراد بها باطل.
لذلك تقوم الدراسة على بيان الترابط الوثيق والدقيق بين أحكام قانون العقوبات، وقانون الأحوال الشخصية قدر تعلق الأمر بمعالجة جزئيات الجرائم الماسة بالرابطة الزوجية، إذ يقع على عاتق الأخير دور تنظيم جزئيات الرابطة الزوجية، فكل حكم فيه له انعكاسه المباشر على الأحكام الجزائية وجوداً وعدماً.
وقد تناول الدراسة التعريف بالرابطة الزوجية لما لذلك من أهمية بالغة في ترتيب الأحكام الجنائية فبينا ماهية الرابطة الزوجية بتعريفها وبيان كيفية إنشائها وشروط انعقادها والأحكام المترتبة على تخلف أحد تلك الشروط، وكيفية انتهائها. ثم تناولنا بيان جذور المعالجة الجنائية للرابطة الزوجية في الشرائع السماوية والقوانين القديمة من حيث التنظيم والتجريم لما لذلك من أهمية في بيان ما اتفقت عليه المجتمعات الغابرة على اختلاف عاداتها ومعتقداتها لتوظيف تلك التجارب في ترصين الرابطة الزوجية.
كما وتناول الدراسة بيان أهمية تنظيم أحكام الرابطة الزوجية المتعلقة بأسباب الإباحة كالحق في التأديب وحق الوطء وكذلك الأمر فيما يتعلق بأحكام التجريم وبالأخص عندما يقترن تحقق أركان الجريمة بوجود الرابطة الزوجية ذاتها، كما في جريمة التوصل إلى عقد زواج باطل وجريمة الزنا وكذلك جريمة تعدد الزوجات خلافاً لقانون الأحوال الشخصية، وجريمة الزواج خارج المحكمة، وجريمة الإكراه على الزواج.
ومن ثم تم بيان أثر الرابطة الزوجية على العقوبة إعفاءً وتخفيفاً وتشديداً. وكذا بيان أثرها على إجراءات الدعوى، ابتداءً بتحريك الشكوى وانتهاءً بتنفيذ الحكم على الطرف الجاني، فضلاً عن أثرها على إثبات الجريمة، وصلاحية القاضي الجنائي الذي ينظر الدعوى وقناعته في بعض الجرائم الماسة بالرابطة الزوجية.
