Book Description
شرعت المعاملات وتعدّدت ووُضعت التشريعات الضابطة لها، وكان لا بد من مراعاة أحكام هذه التشريعات حتى يكون سند التعامل صحيحاً، وغير خافٍ أن إخراج سند التعامل مطابقاً لأحكام القانون الذي يحكم هذا التعامل يستوجب مطالعة هذا القانون وتفهّم قواعد على الوجه الذي أراده المشرّع من وضعه، كما يستوجب مراعاة الإجراءات الواجب إتباعها لإستيفاء الوضع الذي يتم به وضع سند التعامل.
وكل هذا يقتضي جهداً وزمناً، وبما خفى على محرّر السند بعض أحكام قانونية أو أدلها على غير وجهها الصحيح فيخرج السند معيباً فيتعرض للبطلان وفي ذلك من الضّرر بالمعاملات ما لا يخفى.
وقد سدّ المؤلفان هذا النقص وابتكرا مؤلَّفهما النفيس وحرصا على أن يكون محرراً باللغة العربية ليكون أول مؤلف قانوني من نوعه.
وهذا الكتاب يحتوي على صيغ عملية من العقود الرسمية والعرفية الشائعة الإستعمال في القطر المصري وفي الأقطار العربية توخّى المؤلفان في صياغتها أن تكون وفق أحكام أحدث القوانين مع الإشارة إلى المواد الواجبة التطبيق وبيان الإجراءات الواجبة الإتباع لإستيفاء تلك الصيغ.
وممّا عنى به المؤلفان وضع عنوانات هذه الصيغ باللغتين العربية والفرنسية لتعم الفائدة وليسهل الرجوع إلى مصادرها من المؤلفات الأجنبية إذا ما دعت الضّرورة إلى ذلك.
