تتنزّل إشكالية هذا الكتاب في تدبّر منهج المفسّر في قراءته للقرآن ، وقد تمحّض عمله للتشريع للهيئة الاجتماعية ولتنظيم العلاقات بين الأفراد بكيفيات تكفل صلاح معاشهم . ذلك أن المفسّر مزدوج الوظيفة يحدّث عن دلالة توقيفية لنص كما أوحي ، ويشتق عمله من بنية الهيئة الاجتماعية ومختلف المشاغل الطارئة عليها ، وكان هو فيها من بين أطرافها العضوية النشيطة في تشكّلها والإنفعال بها .
فالتاريخية ، في عملنا هذا ، تتعقّب المسافة الفاصلة بين الحكم " كما نزل " والشكل " النهائي " الذي بلغه . فلا معنى أصلاً لحكم نهائي ، لأن الحكم خاضع في تغيّره إلى جملة العوامل الثقافية التي تتميّز بحركتها البطيئة التابعة للطبائع والسلوكات الاجتماعية .
فالتاريخية مرتسمة في تنظير الأصوليين للظاهر مرادفاً للمفهوم ، ومقابلاً للنص ، وهي حاضرة في تفصيل الأصوليين لمقاصد الخطاب وطرق التأويل وفي تصنيفهم الترتيبي لأصول الفقه ؛ وهي الواصلة بين الخبر الناشئ أصلاً وأخلافه ، وهي أيضاً الجرح والتعديل ، وهي الواصلة بين الحكم الفقهي ومرجعه الثقافي وسؤال العمران المتحوّل .
غايتنا في هذا البحث أن نصل إلى أن التشريع الإسلامي قام على أسس ثقافية ، وأن بقاء الحكم الفقهي هو صورة للموقف السائد في المجتمع ، وأن نبيّن أن التشريع ، كما فرضه الفقهاء والمفسرون ، لم يكن الأصلح ، ولا الأوحد ، وإنما قد يعمل المجتمع بآخر هو في نظر المؤسسة الفقهية عدول عن الأصل ، وخروج عن قاعدة التشريع .
ونحسب أنه مهما اجتهد اللاحق في الإحتماء بسلطة السلف فإن للمجتمعات حركية تدفع بها إلى المستقبل ولا تتعامل مع الماضي إلا باعتباره ذكرى حالمة لا غير .
