وقد قام المؤلف وهو بصدد عرض موقف الفقه الإسلامى من عقود المشتقات بإجراء دراسة مقارنة بين نظرية العقود والالتزامات فى القانون ومبدأ سلطان الإدارة فى حرية التعاقد وإنشاء العقود, وموقف الفقه الإسلامى من هذه القضية.
وخلافا لما هو متعارف عليه فى مثل هذه الموضوعات التى أفرزتها الحضارة الغربية, لم يكن المؤلف ناقلا وإنما مناقشا وناقدا حصيفا ورصينا لجميع هذه الأدوات الوافدة علينا والتى يحظر القانون الأمريكى التعامل عليها من قبل الأمريكيين وهو ما أثبته المؤلف بالوثائق الدامغة.
