إن التخطيط السليم للمعركة يتوقف إلى حد كبير على معرفة نوايا العدو وأسراره ومخططاته ورصد تحركاته, ولا سيبل لذلك إلا عن طريق الإستخبارات بواسطة بث العيون وإستخدام الوسائل المتقدمة لمعرفة كل مايتعلق بالأعداء.
ولأهمية هذه الإستخبارات ودورها فى المحافظة على كيان الدولة, فإن الدول قديماً وحديثاً تحرص على جمع المعلومات عن الأخريين وتحيط معسكراتها وخططها بالسرية التامة وتتخذ لذلك الحراسات المشددة مبالغة فى كتمان الأخبار, بل وتفرض أشد العقوبات لمن ينتهك هذه الأسرار, سواء من مواطنيها أم من غيرهم.
فكل دولة من الدول وكل أمة من الأمم تحرص على تحقيق حماية فعالة لأمنها القومى وكيانها من مخاطر العدوان عليه, والقانون الجنائى, يعتبر من أهم الوسائل التى تلجأ إليها الدول لتحقيق ذلك.
ورغم أهمية هذا المووضع وخطورته لم أجد من أفرده بالدراسة المتعمقة التى تلم جزئياته من ثنايا المراجع الشرعية و القانونية, مما جعلنى أقدم على الكتابة فى هذا المووضع رغم علمى بما فيه من الصعوبات, إذ إنه يحتاج إلى الرجوع إلى كتب السنة والسيرة والتاريخ والفقه وغيرذلك, وقد سميته "الإستخبارات العسكرية ودورها فى تحقيق الأمن القومى للدولة فى الفقه الإسلامى و القانون الوضعى".
وقسمت هذا البحث إلى ستة فصول على النحو التالى: الفصل الأول: فى التعريف بالإستخبارات العسكرية وأهميتها وتاريخها والمقصود بالأمن القومى للدولة, الفصل الثانى: حكم الأستخبارات وأنواعها, الفصل الثالث: صفات موظف الإستخبارات, الفصل الرابع: وسائل جمع المعلومات الإستخبارية, الفصل الخامس: وسائل مكافحة التجسس فى الفقه الإسلامى, الفصل السادس: الحماية الجنائية لأسرار الدولة فى القانون المصرى.
