بتاريخ 22/4/1990 صدر القانون رقم 8 لسنة 1990 بإصدار قانون التجارة البحرية، ونصت المادة الأولى من قانون الإصدار على أنه "مع مراعاة القواعد والأحكام الواردة فى القوانين الخاصة يعمل بأحكام قانون التجارة البحرية المرفق، ويلغى قانون التجارة البحرى الصادر فى 13 نوفمبر 1883". ويعرض هذا المؤلف بالدراسة لأشخاص الملاحة البحرية الذين خصص لهم قانون التجارة البحرية الباب الثانى منه الذى تضمن أربعة فصول: الأول "المالك والمجهز"، والثانى "الربان"، والثالث "البحارة (الطاقم) وعقد العمل البحرى"، والرابع "الوكلاء البحريون والمقاولون البحريون". والربان والبحارة وكذلك المرشد يمارسون عملهم على متن السفينة وينتظمهم وصف الأشخاص البحريين، تمييزاً لهم عن الأشخاص البريين الذين يساهمون فى أداء الرسالة البحرية.
ويوجب ما تقدم أن نعرض للمرشد بالدراسة بجانب أشخاص الملاحة البحرية الذين عددهم الباب الثانى من قانون التجارة البحرية رغم أن المشرع إنما عرض للإرشاد فى الفصل الرابع من الباب الثالث من قانون التجارة البحرية الذى خصصه لإستغلال السفينة. وفى نطاق دراستنا وإستكمالاً لها نعرض لمجهز القطر الذى لا شك يساهم فى أداء الرسالة البحرية رغم أن المشرع عرض للقطر فى الفصل الثالث من الباب الثالث من قانون التجارة البحرية. وعلى ذلك نقسم دراستنا الراهنة إلى أبواب سبع، نخصص الباب الأول لمالك السفينة والمجهز، والباب الثانى للربان، والباب الثالث للبحارة، والباب الرابع لعقد العمل البحرى، والباب الخامس للوكلاء البحريون والمقاولون البحريون، والباب السادس للمرشد، والباب السابع والأخير لمجهز القطر.
