يستهدف هذا البحث غاية أبعد من مجرد تناول شرطي المصلحة والصفة فحسب، وإنما يهدف إلى إيضاح الفارق بين دعوى الإلغاء والدعوى الدستورية إزاء هذين الشرطين لاسيما وأن النواحي الإجرائية لم تحظى بالعناية ذاتها التي حظيت بها الجوانب الموضوعية، هذه الجوانب الأخيرة التي تناولتها العديد من المؤلفات والأبحاث التي تزخر بها المكتبة العربية، ولذا تصديت في هذا البحث للشرطين آنفي البيان بوصفها حجر الزاوية في قبول الدعوى، فالانفتاح في شرط المصلحة والصفة يبرز دور دعوى الإلغاء والدعوى الدستورية التي هدفهما موجه إلى القرار الإداري والنص التشريعي، ولكن المصلحة والصفة في دعوى الإلغاء يتميزان بالطبيعة الفضفاضة الأكثر مرونة إلى حد وصف البعض لدعوى الإلغاء "بالدعوى الشعبية"، وهذا ما دعاني إلى تناولهما في دراسة مقارنة.
وقد استخدمت المنهج التأصيلي والمنهج الوصفي، وقمت بتقسيم هذا الموضوع إلى ثلاثة مباحث:-
المبحث الأول: أوصاف المصلحة في الدعوى العادية ودعوى الإلغاء، المبحث الثاني: أوصاف المصلحة في الدعوى الدستورية، المبحث الثالث: الصلة بين المصلحة والصفة في دعوى الإلغاء والدعوى الدستورية.
