تهدف دراستنا لموضوع "مراقبة الأحاديث الخاصة" تأصيل هذا الإجراء الجنائي الهام وتحليله مع خلال بيان مشروعيته والاختصاص به وضماناته وآثاره، كمحاولة فقهية وعلمية لإرساء نظرية عامة تحكم هذا الإجراء. إذ لاحظنا عزوف غالبية الباحثين- إلا ما قد ندر- عن الخوض في هذا الموضوع رغم كثرة المشاكل المتعلقة به وحيويته والحاجة إلى البحث عن حلول له، فكل الأبحاث والدراسات تبسط أهميتها على جرائم الاعتداء على سرية الأحاديث دون أن تحظى المراقبة الالكترونية كإجراء جنائي يمس حق الإنسان في سرية حديثه بالقدر الكافي من الاهتمام.
وسيلمس القارئ الكريم أننا أعطينا مزيدًا من الاهتمام للتطبيقات العلمية من خلال الأحكام القضائية، لإيماننا بأن أهمية أي بحث قانوني- وخصوصًا فيما يتعلق بالإجراءات الجنائية- لا تحقق إلا من خلال التطبيق العملي للنصوص، غير أننا لم نتلقى أحكام القضاء على أساس أن ما يقرره من المسلمات وأن مبادئه أشبه ما تكون بالقواعد القانونية وإنما قلبنا هذه الأحكام على وجهها لتأكيد سلامتها أو التحفظ عليها أو الاختلاف معها في ضوء نصوص الدستور والقانون فذلك هو الميزان الذي نزن به تلك الأحكام.
