إن الحماية القانونية لمعلومات شبكة الإنترنت بالإضافة إلى كونها موضوعاً لم يتطرق إليه فقه القانون الخاص بالدراسة والتحليل إلا حديثاً، فإنه لم يكن كذلك محلاً لتنظيم تشريعي خاص إلا في بعض القوانين المقارنة؛ وبهذه الصورة فإنه يتميز بخصوصية ذاتية من حيث صيغ هذه الحماية ومن حيث طبيعة الأحكام التي يجب أن تخضع لها وإختلاف آثارها.
إن هدف هذا الكتاب هو إظهار مدى المتغيرات القانونية التي يمكن أن تؤثر على حرية تداول المعلومات من خلال وسائل التقنية الحديثة، والوقوف على كيفية التعامل معها بصورة قانونية سواء من خلال تطبيق أحكام القواعد العامة أو بحكم النظام العام والآداب، وتحليلها بالصورة التي تؤمن تنفيذها وتطبيقها بما يتفق مع عوامل التطور التقني دون الحدّ منه.
وقد تم تقسيم الكتاب على وفق خطة بحث تضم أبواباً ثلاثة يسبقها فصل تمهيدي يتناول بالعرض والتحليل الجانب الفني للمعلومات من حيث طبيعتها والإشكالات التي تثيرها، يتناول الأول حماية المعلومات من خلال أحكام براءات الإختراع، بينما ينصب الثاني على دراسة مدى إمكانية تطبيق أحكام حق المؤلف كوسيلة لحماية تلك المعلومات.
أما الباب الثالث والأخير فإنه يعرض لحماية المعلومات وفقاً قواعد المقررة في المسؤولية الجنائية، أخذين بنظر الإعتبار مبدأ (لا جريمة ولا عقوبة إلا بنص)، ويشتمل هذا الباب على فصلين، يختص الأول منهما بدراسة الجوانب القانونية للجريمة المعلوماتية ويتناول الفصل الثاني تحليل وتوصيف الجرائم المعلوماتية الحاصلة على شبكة المعلومات، وإنتهينا بخاتمة للكتاب تتضمن ما توصلنا إليه من النتائج والمقترحات.
