وفقاً لتقارير المصرف المركزي القطري فقد احتل قطاع البناء والتشييد مركزاً متقدماً من حيث الأهمية النسبية في الناتج المحلي الإجمالي حيث استمر ناتجه في الزيادة خلال العام 2007 نتيجة للطفرة الكبيرة في مجال البناء والتشييد في كافة مناطق البلاد.
أما على الصعيد القانوني فقد صدرت خلال السنوات الاخيرة حزمة كبيرة من القوانين والتشريعات تهدف لتنظيم مختلف جوانب الحياة السياسية والاقتصادية والاجتماعية في الدولة، وجعلها مواكبة للتطورات الهائلة التي تشهدها الدولة، ومن بينها قوانين هامة تتعلق بقطاع البناء والتشييد وتؤثر عليه، مثل قانون تنظيم مزاولة المهن الهندسية لسنة 2005، والقانون المدني لسنة 2004.
ويستعرض هذا الفصل البيئة القانونية الحاكمة لقطاع البناء والتشييد في دولة قطر عبر تتبع أهم القوانين المنظمة لهذا القطاع، والهيئات الحكومية المختصة بتنظيم هذا القطاع، الفصل الثاني: خصصناه لاستعراض أحد أهم القوانين في منظومة القوانين المنظمة لقطاع البناء والتشييد، وهو قانون تنظيم المباني لسنة 1985، ولائحته التنفيذية.
الفصل الثالث: يتناول قانون تنظيم مزاولة المهن الهندسية لسنة 2005، وهو القانون الذي حل محل القانون رقم (11) لسنة 2001، الذي كان الأول من نوعه في تنظيم مزاولة المهن الهندسية بدولة قطر.
والفصل الرابع: يتناول هذا الفصل الضوابط القانونية لعمل المقاولين، وهي من المناطق التي تحتاج للتطوير في القانون القطري، الفصل الخامس: يسعى هذا الفصل لتقديم تصور عام حول العقود المعمول بها في صناعة البناء والتشييد. وذلك عبر مبحثين، يتناول المبحث الأول طبيعة وأنواع عقود البناء والتشييد، المبحث الثاني المكونات القانونية لعقد البناء والتشييد.
الفصل السادس: في هذا الفصل الختامي سعينا لتقديم ملخص واف وغير مخل لجوانب المسئولية القانونية المترتبة على أعمال البناء والتشييد.
