إن كل القوانين والتشريعات التي تستهدف الإنسان وتحمل برنامجاً لحياته إذا أُريد لها أن تأخذ طريقها إلى الساحة الحضارية، لا بد من أن تعلن عن موقفها تجاه مسألة حقوق الإنسان وتوضح مدى الحماية التي توفرها لها، ولهذا نجد أن كثيراً من القوانين التي لم تكن تُعِر أهمية كبيرة لحقوق الإنسان، ولا تحول دون إنتهاكها قد حذفت من قاموس الحياة.
ذلك أن إهدار حقوق الإنسان معناه إنكار الحقيقة الإنسانية بعدها ظاهرة إجتماعية، لأننا فعلاً لا نتحدث عن الإنسان بعده ظاهرة فيزياوية أو بيولوجية، كي يقال بعدم صدق هذه الملازمة، حيث إن محط النظر ليس الموجود الذي يتحرك وله حيز من الفراغ، ولا الكائن الحي الذي يتنفس وينمو ويتكاثر، بل إن الأنموذج المبحوث عنه هو المخلوق المفكر الفاعل، والمسؤول ذو الآمال والتطلعات، الذي كرمه الله سبحانه وتعالى وجعله خليفته في الأرض قال تعالى: ﴿ وَلَقَدْ كَرَّمْنَا بَنِي آَدَمَ وَحَمَلْنَاهُمْ فِي الْبَرِّ وَالْبَحْرِ وَرَزَقْنَاهُمْ مِنَ الطَّيِّبَاتِ وَفَضَّلْنَاهُمْ عَلَى كَثِيرٍ مِمَّنْ خَلَقْنَا تَفْضِيلاً ﴾.
وبهذا فقد جاء إختيار هذا الموضوع، بعدما استبان ما يمكن أن يكون لدراسة حق المتهم في الصمت من أهمية فقهية وقضائية، والتي من خلالها يتم إختيار المواد التي تنسجم مع السياسة القضائية والتشريعية في العراق، والتي من الممكن أن توفر الحماية الكافية لأهم حق من حقوق المتهم، ألا وهو حقه في الصمت.
