إن الإسلام دين فطري ذاتـي الانتشار والرسوخ، لا عليك إلا أن تترك لـه الحرية كاملة حتى يعتنقه الناس من أعدائه ويتشبثوا به أشد من المنتسبين إليه، فإذا اشتعلت نيران الفتنة أخذتهم في سكراتها، فلا يستيقظون إلا وقد أخذت النار خيارهم قبل شرارهم، وابتلعت دعاة حقن الدماء قبل المفسدين في الأرض.
ثم تخبو النار لبرهة من الزمن يستعيد الناس فيها أنفاسهم، لا يلبثون بعدها أن يلِجوا دورة جديـدة من دورات الفتنة وجحيمها، وأنى لنارٍ ـ خبا شرر جمرها الملتهب تحت رماد حرية المصالح المؤقتة ـ أن تنطفئ؟!
عالجتُ في هذا البحث ثلاث مشاكل على التوالي: 1 ـ ضبط مصطلح الفتنة. 2 ـ التفريق بين قتال الفتنة وغيره من أنواع القتال. 3 ـ بيان الأحكام التفصيلية لقتال الفتنة.
حيث أن القتال ينتج عنه إزهاق أرواح، وتلف أموال، وأحياناً ينتج عنـه تعدٍ على الأعراض، وهذه مفاسد واقعة على بعض الضرورات الخمس. كما أن هناك التباس قتال الفتنة على كثير من الناس، وعدم تمييزهم بين القتال المشروع وغير المشروع، والجهل بحكم الاشتراك فيه.
وهكذا اقتضت ضرورة البحث تقسيمه إلى تمهيد وبابين وخاتمة. اشتمل التمهيد على تعريف الفتنة وضوابط قتالها وبعض أنواع الفتنة. أما الباب الأول فهو في: ’ماهية الفتنة الفقهية‘، وقد احتوى على فصلين: ـ الفصل الأول: التعريف الفقهي للفتنة، والمصطلحات المتعلقة بها. الفصل الثاني: ضوابط قتال الفتنـة، وموازنته بأنواع القتال الأخرى.
أما الباب الثاني فهو في: ’أحكام قتال الفتنة‘. ويحوي أربعة فصول: ـ الفصل الأول: أحكام الإصلاح بين الجماعتين المتقاتلتين. الفصل الثاني: أحكام قتال الباغي ونصرة المحق فـي قتال الفتنـة.الفصل الثالث: أحكام الأموال والقتلى. الفصل الرابع: أحكام تعامل الناس في الفتنة. أما الخاتمة فهي تتضمن أهم نتائج البحث، والتوصيات، والمقترحات.
