قيود السلطة التأديبية تحكم العلاقة بين صاحب العمل، والعامل في أحلك فترات هذه العلاقة، وهي فترة التوتر التي تسودها عندما يمارس صاحب العمل السلطة التأديبية، ويبدو في أوج قوته وعنفوانه، ويكون العامل في أضعف ما يكون عليه، هذه القوة التي يبدو فيها صاحب العمل ترسخ لدي العامل الإحساس بالظلم، والشعور بعدم الرضا والرغبة في التمرد، والانتقام مما يثرى الصراع الطبقي الذي يهدد استقرار المجتمع. فصاحب العمل يقوم بجميع الأدوار خلال تلك الفترة فهو الخصم والمحقق والحكم.
لذا تجلت أهمية قيود السلطة التأديبية، ودراستها، في أنها تحاول إقامة نوع من التوازن خلال تلك الفترة الحرجة، بفرض العديد من القيود علي صاحب العمل، فهذه القيود ليست مقصورة بذاتها، بل لكونها تعتبر في نفس الوقت ضمانات للعامل، تهدف إلي حمايته ضد احتمال التعسف في استعمال السلطة التأديبية.
ولا تقتصر فائدة هذه القيود علي العامل فقد بل تمتد لتشمل المجتمع بأسره عن طريق تحقيق الاستقرار له في عمله. فمعرفة كل طرف من طرفى علاقة العمل بحقوقه وواجباته، من أين يبدأ؟ وأين ينتهي خلال ممارسة صاحب العمل السلطة التأديبية؟ يؤدى إلي تخفيف حدة التوتر بينهما، وتفرغ العمال الذين يشكلون أغلبية المجتمع لممارسة عملهم بعيداً عن التناحر والشد والجذب بينهم وبين أصحاب العمل؛ وبالتالي حماية بنيان المجتمع من الصراعات الطبقية ونشر السلام الاجتماعى.
لذا فإننا نأمل من خلال هذه الدراسة توضيح حقوق، وواجبات كل طرف منهما في محاولة لتحقيق نوع من الوعي، وبالتالي المساعدة علي استقرار علاقتهم أثناء هذه الفترة.
