إذا كان علماء الإسلام جديرين بالتقدير والشكر، لما بذلوا من جهد في بيان المعارف الإسلامية- فإن من بواعث فخرهم سبقهم إلى وضع قواعد لاستنباط الأحكام من النصوص التشريعية، مما لم يجارهم فيه من أهل الشرائع الأخرى، وإنما دعاهم إلى هذا ما امتاز به الإسلام من العناية بأمري الدين والدنيا، والملاءمة لكل زمان وكل مكان، هذا ما امتاز به الإسلام من العناية بأمري الدين والدنيا، والملاءمة لكل زمان وكل مكان، فإن ذلك العموم وتلك المرونة جعلا مصادر التشريع فيه صالحة للاستنباط في كل آن، وكان لزاما ألا يترك أمر الاستنباط منها لفوضى الأهواء ونوازع الشهوات، حتى لا تستغل أسباب الصلاح في الإفساد، ولا تكون الشريعة وسيلة إلى البغي والعدوان بين العباد.
وقد قمت بتدريس هذا العلم في كلية دار العلوم، واطلعت على ما تهيأ لي من كتب المتقدمين والمتأخرين، فحاولت في هذا المختصر أن أجمع من تلك الرياض الواسعة طاقة متناسقة، سهلة واضحة، ترسم لذلك البحر المترامي الأطراف صورة محدودة، وتنير السبيل للطالب، فتجلى له ما خفى، وتسهل عليه ما صعب.
وقد أشرت في كثير من المواضع إلى بعض المراجع التي تنفع الباحث وتعينه على الوصول إلى الغاية، عند الرغبة في الإفادة، والحاجة إلى الاستزادة.
ثم كان للمراجعة الطويلة بعد ذلك، والتفهم لأغراض الشريعة من أصولها الأولى، والرغبة في الملاءمة بين المأثور من ذلك وحاجة الأمة في كل العصور - أثر في تنسيق هذه الطاقة جديداً: يوافق تلك الأصول، ويسر فهم هذا العلم.
