نظام التأديب فى الأصل هو مظهر من مظاهر الرئاسة الإدارية التى تفرضها طبيعة التنظيم الإدراى بل أنه نابع منها ومتفرع عنها حتى ولو كانت الولاية قد عهد بها إلى هيئة قضائية متخصصة. وهذا النظام يتميز بشخصية مزدوجة بمعنى وأن كان نظاماً طائقيا فى مجال الشخصى إلا أنه نفس الوقت نظام عقاب فى ماهيته وطبيعة الجوهرية واسلوبه. ونظراُ لخطورة التأديب فقد أحاطه المشرع بضمانات تحميه عن عسف الإدارة وإساءة استعمال السلطة. لذلك رأينا ان نعرض لهذا النظام بشئ من التفصيل باعتبار أنه يجب إقامة توازن دقيق بين مقتضيات القانون وبين فاعلية الإدارة.
