إن من أعظم قواعد السياسة الشرعية، والولايات العامة والخاصة في الإسلام: قاعدة (تصرف الإمام على العرية منوط بالمصلحة)، فهي تجلي حدود السلطة العامة، ومعالم التدبير الإداري، في حكم الولاة وتصرفاتهم على العرية؛ ذلك أن الولاة- من الخليفة فمن دونه من الأمراء والعمال وكبار الموظفين- وكلاء عن الأمة في النهوض بأمور معاشها، وإقامتها على أصلح التدابير، جلبًا للرشاد، ودرءًا للفساد، وحسمًا لمادة الاضطراب والتهارج وفوت الأمان، مما يعبر عنه في عرف الفقهاء بالمصلحة العامة، فكل تصرف من الولاة جاء على خلاف هذه المصلحة، أو كر عليها بالنقض، مما يقصد به الاستئثار بالمنفعة، أو مجاراة هوى النفس، فهو باطل مردود، ولا عبرة به في فقه السياسة الشرعية.
ولعل البيئة في طليعة القضايا التي ينبغي أن تحاط باهتمام فقهاء العصر، وتنزل في أولويات التأصيل الشرعي منزلة الصدارة، لارتباطها بموارد العيش، ومستقبل التنمية، ورخاء الأجيال القابلة؛ ولهذا آثرنا أن تكون تطبيقات القاعدة موصولة السبب والنسب بالمضمار البيئي وتنميته المستدامة، وهنا تكمن جدة هذا العمل وإضافته المعرفية.
وقد استوت خطة الدراسة في خمسة مباحث: الأول في توثيق القاعدة وبيان صيغها المتداولة عند الفقهاء، الثاني في بيان مفردات القاعدة، الثالث في بيان فقه القاعدة، الرابع في بيان أدلة القاعدة، الخامس في بيان تطبيقات القاعدة في المجال البيئي. أما المنهج الذي آثرنا ترسمه في الدراسة فهو المنهج الاستقرائي في توثيق القاعدة، والتأصيلي في بيان فقه القاعدة، وعزو الآيات وتخريج الأحاديث النبوية، وأخيرًا التعريف بالغريب من المفردات.
