بحثٌ فقهيٌّ في باب تضمين الصِّبيان الذين لم يبلغوا سنّ التكليف للتعدِّيات أو الإتلافات في حقوق الآخرين، وبيان وجوب ضمان أي تصرُّف يصدر منهم بالمال؛ مع كونهم ممن لا تُقام الحدودُ عليهم لعدم التكليف؛ ذلك أن من مقاصد الشرع الحنيف الحفاظ على النفوس والأموال، أياً كان ذلك المتعدِّي، حتّى لا تذهب حقوق الناس هدراً؛ إذْ إنّ ضمان تعدِّي الصبيان في المعاملات أو في الحدود والجنايات حافزٌ للعناية بالصِّغار ومتابعتهم، ومانع من استخدام غيرهم لهم في الاعتداء على أموال الآخرين. وقد جاء هذا البحث في أربعة فصول: فصلٌ تمهيديٌّ يعرف بمفاهيم التضمين والضمان، والمال، والتصرف وأنواعهما، ثم مفهوم الصغار، تلاه فصلٌ حول الأحكام المتعلقة بضمان الأموال وتعويضها، والأحكام المتعلِّقة بمراحل الصغار، والأموال التي وقع عليها الضرر، وجاء الفصل الثالث في التطبيقات على تضمين تصرفات الصِّبيان في العبادات والأحوال الشَّخصية والمعاملات، وبحث الفصل الأخير تضمين تصرفات الصِّبيان في الحدود والجنايا.
