لم ينشأ القانون الدولي الإنساني من فراغ بل هو إفراز لمجموعة من القيم والمبادئ الأخلاقية التي تدعو في الإطار العام إلى نبذ الحروب بين الدول والشعوب والرجوع إلى الحل السلمي للمشكلات التي تنشأ بين الدول، وإذا ما وقعت الحرب فإنَّ ثمة اعتبارات ذات طابع إنساني يجب إعمالها. إنَّ المجتمع الدولي المعاصر في ظل ميثاق الأمم المتحدة قد أصبح يقوم على مبدأ أساسي هو تحريم استخدام القوة أو التهديد بها في العلاقات الدولية ولكن الواقع الدولي يكشف عن تزايد المنازعات المسلحة في أرجاء متعددة من العالم وهذا يتطلّب العمل على تطوير وإنماء قواعد القانون الدولي الإنساني الذي يحكم تلك المنازعات وبذل الجهود من اجل كفالة أكبر قدر من الإحترام لمبادئ الإنسانية فيها.
