أحمد عيسى: طبيب وأديب ومؤرخ مصري، وُلِدَ بمدينة رشيد في محافظة البحيرة عام ١٨٧٦م، وأتم تعليمه الأساسي بها، ثم انتقل إلى المدرسة الخديوية، والتحق بعدها بمدرسة الطب بالقاهرة.
تخصَّص عيسى في أمراض النساء، كما عمِل بالطب الباطني في العديد من المستشفيات، إلا أنه لم يستمر في مزاولة المهنة، واتَّجه إلى التأليف والترجمة، وكان يحرص على حضور الدروس في تخصُّصات معرِفية أخرى بالجامعة المصرية (جامعة القاهرة).
وقد أجاد أحمد عيسى بعض اللغات السامية، واليونانية، واللاتينية.
كان عضوًا في العديد من الجمعيات والمجالس كجمعية الهلال الأحمر، ومجلس المجمع العلمي بدمشق، والمجلس الأعلى لدار الكتب المصرية، والأكاديمية الدولية لتاريخ العلوم بباريس، وقد انتقل عيسى إلى رحاب الله عام ١٩٤٦م.
Book Description
يعالج هذا الكتاب مختلف الجوانب القانونية للمرفق العام الطبي لا سيما مسؤولية المستشفيات الحكومية، كأحد أشخاص القانون العام، عن الأضرار التي تسببها للمنتفعين من الخدمات الصحية التي تقدمها.
ففي العام 1996 صدر القانون رقم 544 الذي عدل بموجب القانون رقم 602 تاريخ 28/شباط/1997 مما أوجد ورشة إصلاح وتحديث على صعيد الخدمات الصحية التي تقدمها المستشفيات الحكومية، الأمر الذي دفعنا إلى بحث هذه العلاقة القانونية إن من خلال النصوص التشريعية المقارنة، أو من خلال التطور الاجتهادي للقضائين العدلي والإداري.
إن المرفق العام الطبي يعامل معاملة استثنائية تختلف عن باقي المرافق العامة الإدارية، فقد أوجد الاجتهاد الإداري من خلال عمل المستفشفيات الحكومية مفاهيم لم تكن تأتلف مع طبيعة عمل السلطة العامة ومع مفاهيم ومبادئ القانون الإداري.
لذلك يمكن لهذا الكتاب أن يكون بمثابة قنديل يضيء ظلام عمل الأطباء ومسؤولياتهم لا سيما لدى المستشفيات الحكومية، بحيث يستطيع كل من المحامي أو القاضي أو الباحث أو الطالب أن يستنبط من هذا الكتاب حقيقة هذه العلاقة القانونية، خاصة أنه لم يسبق لأحد أن تناول هذا الموضوع حتى الآن.
