لا يجوز لحاكم أن يحكم إلا بما أنزل الله، وإن الناس لا يحق لهم أن يأخذوا إلا ما لهم به حق، وأن لا طاعة لمخلوق في معصية الخالق، وحُكم الحاكم وما يأمر به أولياء الأمور من رسوم أو حقوق ما من شيء منه يجوز أن يخالف شرع الله، وإن حُكم الحاكم لا يحلل حرامًا ولا يحرم حلالًا؛ فإذا أبرأ القاضي إنسانًا وهو في الحقيقة مدين لم يبرأ منه عند الله ولم يحل له بذلك حق أخيه وإن عجز عن إثبات دعواه، ثم إن كل حيلة أو سبيل أو حكم أو طول زمن أو غفلة من صاحب الحق لصغر سنـه أو لعجزه أو لضعفه أو لحكم يصدره الحاكم- كل ذلك لا يجوز أن يكون شيء منه يحول دون الحق وصاحبه.
