Book Description
يعد التملود أحد أهم مصادر التشريع اليهودي بعد "العهد القديم" ، و "المشنا" ، بل ربما يحتل مكانه متقدمه عليها فى بعض المسائل.
وهناك تلمودان : أورشليمى وبابلى ، وهما نتاج مدارس يهودية عدة فى فلسطين وبابل "3000 - 5000"م.
التلمود البابلى هو الأضخم حجما والأكثر دراسة والأفضل حفظا ويتضمن التلمود بشكل عام تشريعا قانونيا ، ومنهجا أخلاقيا ، وجكله من الطقوس والشعائر الدينية ومقطوعات شعرية وصلوات وقصص تاريخية ، وطرائف وحكايات شعبية وأساطير.
تنقسم الماد التى تشكل لب التلمود الى قسمين ، يعرفان بالهالاخاه والهاجاده فالهالاخاه تتعلق بالأجزاء التشريعية. وهى الاستنباط المنطقى لأجيال من العلماء.
وشكلت الهالاخاه أسلوب حياة اليهودى. أما الهاجاداه فتتعلق بالأقسام غير التشريعية وهى أقسام تتساوى فى أهميتها مع الأقسام الأخرى. وعلى الرغم من التناقض الحاد بين الهالاخاه والهاجاه. فإنهما تكملان بعضهما البعض ، وتنبثقان من أصل واحد وتهدفان للغاية نفسها. فلم يكن التلمود يتضمن فقط المحصلات الاخلاقية والتشريعية لبحوث المتعلمين بل يتضمن أيضا الحكمه ، والمعتقدات الخرافية لعامة الناس ، وهو ليس تشريعا وأدبا وحسب لكنه رابطه فريده بين اليهود ووثيقة روحية لانظير لها للحفاظ على الهوية اليهودية وسط كثير من المحن التى تتعرض لها اليهود عبر التاريخ. وبعد التلمود لذلك - بالنسبة لليهود - واحدا من أعظم الكتب وعلى الرغم من زلاته أو اخطائه وإفراطه فى التفاصيل ، وافتقاره إلى الأسلوب والشكل وقوانينه التفصيلية وقيوده المذهله.
