رأيت بحث الإباحة مختفيًا في ثنايا الأحكام الشرعية التي يعرضها الفقهاء حتى أنهم في كثير من الأبواب ينصون على واجبات الماهية الشرعية ومكروهاتها ومسنوناتها، دون تعرض لمباحاتها إلا أن يكون عفوًا ضمن موضوع آخر، كما وجدت الأصوليين حين يتناولون الكلام عنها يتناولونها في أبواب متفرقة وموضوعات متباعدة دون تجميع لشتات الموضوع، ولا تأصيل نظرية له.
لذلك عمدت إلى أن أبرز هذه الناحية وأن أجمع ما تصل إليه طاقتي من دراسات الفقهاء والأصوليين، وأعلق بما يفتح الله به علي فيما يحتاج من ذلك إلى التعليق، مع توخي العرض في أسلوب يناسب لغة العصر، ويتفق مع كل ذهن وفكر في محيطنا الفقهي محاولًا مع ذلك تأصيل الموضوع ووضع نظرية خاصة به تجمع شتاته وتظهره بوضوح تليق بأهميته.
منهج البحث: هذا وقد قسمت البحث إلى تمهيد وخمسة أبواب وخاتمة. أما التمهيد فإننا نريد أن نتعرف به كون الإباحة داخلة في الحكم الشرعي أو خارجة عنه، وذلك يقتضي أن نبين معنى الحكم في اعتبار كل من الأصوليين والفقهاء، ثم نعقب بتعرف معنى الحكم عند رجال القانون. وأما الباب الأول، فهو في معنى الإباحة وأساليبها وأقسامها. والباب الثاني في متعلق الإباحة وأثرها. أما الباب الثالث: فقد خصصناه لبيان أن الإباحة في ذاتها لا تدل على طلب الفعل ولا الترك. الباب الرابع: تكلمنا فيه عن طروء الإباحة على كل من المحظور والواجب. الباب الخامس: في ما لم يرد به نص أو جهل حكمه. والخاتمة: جعلناها فذلكة للبحث أجملنا فيها ما انتهينا إليه.
