في هذا الكتاب نص دونه المحامي "أحمد السقا" كجزء من رسالة جامعية كان قد قدمها كأطروحة للدكتوراه لكلية الحقوق بباريس في سنة 1916 تحت عنوان "السيادة والقانون العام الإسلامي السني" وبالنظر لما يكتسبه هذا الجزء من أهمية تاريخية وتوثيقية بالغة الأهمية فقد اعتنى "حمادي الساحلي" بتعريبه وإدراجه متن هذا الكتاب الذي بين يدينا.
وبالعودة لمادة هذا الجزء من الرسالة نلاحظ أن المؤلف قد خصصه لبحث موضوع "نظام الحكم في الإسلام"، من عهد الخلفاء الراشدين إلى العهد الحديث،ولتحليل قضية الخلافة التي كانت تستأثر وقتئذ باهتمام الباحثين والمفكرين في العالم الإسلامي، وقد اعتمد الكاتب في بحثه على كتب التراث ولا سيما منها كتاب الماوردي "الأحكام السلطانية"، مستشهداً بالآيات القرآنية والأحاديث النبوية التي لها صلة بهذا الموضوع.
وقد اعتبر أحمد السقا المتأثر لا محالة بتفكير رجال الإصلاح المسلمين، أمثال: خير الدين التونسي وجمال الدين الأفغاني ومحمد عبده، أن السيادة في القانون الإسلامي العام لم تكن مطلقة، حيث إن الخليفة مطالب بضمان قيام مجتمع إسلامي حرّ، وبحكم الأمة على أساس مبدأ الشورى، مصدقاً لقوله تعالى: "وأمرهم شورى بينهم".
واستنتج المؤلف من بحثه أن الحكم المطلق في الأقطار الإسلامية ناتج عن تزعزع العقيدة في النفوس، "وأن التوسع الهائل لنظرية القضاء والقدر الخاطئة، هو الذي تسبب في انحطاط الأمة الإسلامية، تلك الأمة التي دوّخت امبراطوريات عريقة وأخضعت العالم لسلطانها...".
ثم ختم بحثه ملاحظاً: "إن تنظيم الأمة للاضطلاع بمهمتها لدى الأمير، والسهر على ضمان الشرعية، لهو من الضرورات الحيوية والحتمية التي لقنها لنا التاريخ... وأن الشعوب الإسلامية المنتشرة عبر العالم قد بدأت تستعيد وعيها بعد سبات دام عدّة قرون".
