لا تنشغل المقاربة المفترضة لهذا المبحث بمسار تطور التفكير في المسألة فحسب، بل تبحث في مختلف العوامل الفاعلة التي أسهمت في صياغتها ضمن تصوّر أصولي تاريخي وإنساني لسلطة العرف على التشريع الإسلامي.
ولذلك، إذا كان بحثنا مقيّداً بمنهج تاريخي يدرس المفهوم وتجلّياته في المدونة إنطلاقاً من النشأة والتأسيس مروراً بمراحل التحوّل إلى حدود إستقراره وثباته ورسوخه، فإنّه لا يعني البتة الوقوع في سردية عرض الآراء بمعزل عن التحليل الذي يراعي المكونات الثقافية المساهمة في بلورة رؤية كانت تتشكّل تدريجياً ضمن الدّائرة التأويلية الخاصة بها.
... إن الغاية المرجوة من هذا البحث - وإن كانت تحوم حول إعادة النّظر في بعض المسلمات الراسخة في مباحث الفكر الإسلامي التي طغت عليها المقاربات التمجيدية والتبجيلية والتبريرية، وأسهمت من حيث لا تدري في شيوع الكثير من المغالطات حول التراث والفكر الأصولي - تسعى إلى إماطة اللّثام عن دور الأصوليين في تحيين منظومته وتعديلها بإستمرار في ضوء التحوّلات دون المساس بجوهرها المتفق عليه سلفاً.
ومن هنا، يرد مثال العرف مجسّداً لهذا العمل، فقد عرف مفهومه تحوّلات وشهدت طريقة التعامل معه تنوعاً، وكشف من خلال ذلك عن دوره الخفي والمؤثّر في جعل الشريعة تواكب التحولات التّاريخية عمليّاً، على الرغم من إحتفاظها بقوالبها النّظريّة الجاهزة.
وقد يكون ذلك سبباً من أسباب ظهور المواقف المتناقضة أحياناً عند البعض حينما يقدمون العرف أو المصلحة على النصّ في بعض إجتهاداتهم وفتاويهم وأحكامهم.
