في هذا الكتاب نعرض لرقابة المطابقة الدستورية المشروطة في مباحث ثلاثة، نتناول في المبحث الأول منها مفهومها وحقيقتها في إطار النماذج التقليدية للرقابة على دستورية القوانين، من خلال دراسة مقارنة بين أكثر من نموذج للرقابة. بينما نكرس المبحث الثاني لتطبيقات معاصرة لهذا النوع من الرقابة في قضاء المحكمة الدستورية الإيطالية والمجلس الدستوري الفرنسي، ثم نحاول هنا في هذا المبحث الوقوف على مدى وجود تطبيقات في قضاء المحكمة العليا الأمريكية المحكمة الدستورية العليا المصرية، بحسبان أن في مثل هذه التطبيقات ما يمثل استجلاء للفكرة، فيكون ذلك مفيداً للوصول إلى تطبيق نموذجي للمفهوم في القضاء الدستوري المصري، على أن يلي ذلك التعرض في المبحث الثالث والأخير لجانب شديد الأهمية لهذا النوع من الرقابة، ألا وهو الإطار القانوني له، فنبين شروط لجوء القضاء الدستوري إليه، وشروط الإقرار بمشروعيته الدستورية والسياسية، ثم أخيراً لحجية الرقابة التي تتمخض عنه، وغني عن الإشارة أخيراً التنويه إلى أن دراسة الموضوعات المشار إليها ستكون من خلال أسلوب الدراسة المقارنة.
