قامت هذه الدراسة بتحليل ونقد أهم معالم الإجتهاد بصورة عامة، وتناولت المقاصد الشرعية كعامل مُساعد للمُجتهد في الإجتهاد، وأظهرت إعتراض ابن تيمية على الأصوليين حصرهم الضروريات في الخمس المشهورة.
تناولت هذه الدراسة تحليل المُمارسة الفقهية التطبيقية التي أجراها ابن تيمية في المعالجة الشرعية لواقع الناس، من خلال فهم أصول الإستنباط عنده إستقراءً وتحليلاً، وتطبيق هذه الأصول على بعض النماذج الفقهية، مع مُراعاة فهم كيفية إستثمار ابن تيمية للمقاصد الشرعية.
من أهم النتائج التي أبرزها البحث أن منهج ابن تيمية العام يقوم على تأكيد المرجعية للنصوص (الكتاب والسنّة)، وعلى شمولية هذه النصوص للأحكام كلها، وأن فروع المسائل الفقهية مهما كثرت فإن أصولها الكلية ترجع لا محالة إلى النصوص، وقد أظهر ابن تيمية أن الأدلة المُخْتَلف فيها ليست مستقلةً في إنشاء الأحكام.
