بحثنا- هذا- فى التضامن، يستقى مقينة من أحكام الالتزام وأثاره يصفة أصلية، ومن باقى موضوعات الالتزام، كلما اقتضى الحال ذلك.
فمصادر الالتزام التى نص عليها القانون المدنى، خمسة، هى: العقد، والإرادة المنفردة، والعمل غير المشروع، والاثراء بلا سبب، والقانون،
وقد أقام عميد القانون الدكتور عبد الرزاق أحمد السنهورى هذا الترتيب للمصادر على أساس منطقى سليم.
وقد جرت موضوعات القسم الأول من القانون المدنى (الالتزامات أو الحقوق الشخصية)- كما يلي:
الكتاب الأول : الالتزامات بوجه عام
الباب الأول- مصادر الالتزام
الباب الثانى- أثار الالتزام
الباب الثالث- الأوصاف المعدلة لأثر الالتزام
الفصل الأول- الشرط والأجل
الفصل الثانى- تعدد محل الالتزام
الفصل الثالث- تعدد طرفى الالتزام.
الفرع الأول- التضامن
الفرع الثانى- عدم القابلية للأنقسام.
وقد قعدت التضامن. الفرع الثانى- عدم القابلية للانقسام.
وقد قعدت التضامن، موضع البحث 21 مادة هى المواد من 279 حتى 299 من القانون المدنى. ويشمل شرحها أحكام التضامم.
أما القسم الثالث من البحث: الكفالة فقد وردت احكامها ضمن الكتاب الثانى (العقود المسماة) من القسم الأول من القانون المدنى وقد تضمنها الباب الخامس منه، على النحو التالى:
الفصل الأول- أركان الكفالة
الفصل الثانى- آثار الكفالة.
والكفالة عقد ضمان تابع ولهذا فقد جمعناها فى بحثنا جنباً إلى جنب مع التضامن والتضامم، حتى يكون وافياً.
