عُرفت الوصية منذ قديم الزمان، فقد عرفتها الشرائع والقوانين المختلفة، وإن أحكامها تختلف من شريعة إلى أخرى كما أنها تختلف من قانون إلى آخر، وقد عرفها الإنسان كوسيمة من وسائل نقل الملكية إلى الغير على مر العصور بأشكال وأنواع مختلفة في كل عصر وزمان.
كانت الوصية عند البابليين والرومان واليهود مطلقة من كل قيد، إذ كان بإمكان الشخص أن يوصي بأمواله لمن يشاء ويحرم أولاده كلياً من الميراث، وكذلك الحال عند قدماء المصريين.
أما الوصية لدى العرب، فكانت قبل الإسلام مباحة في معاملاتهم وتصح بكل المال أو بعضه، فكانوا يوصون إلى بعضهم البعض من غير إرتباط بأي قانون أو تشريع ينظم ذلك على وجه العدالة والإنصاف.
بعدها جاء الإسلام بشريعته الغراء فنظم الوصية تنظيماً دقيقاً، وجعل القاعدة الأساسية في ذلك مبدأ (الأقربون أولى بالمعروف)، وبين الكيفية والطريقة التي يتمكن بها الإنسان من التصرف بأمواله بعد موته ومقدار ذلك.
كل ما تقدم هو وصية إختيارية يوصي فيها الموصي طواعية بجزء من ماله، أما الوصية الواجبة تكون في تركة المتوفى من غير إرادة صادرة عنه ولا عبارة منشئة لها من المتوفى، وغير متوقفة على أجازه الورثة، وعليه تكون واجبة بموجب القانون، ورغم أن الوصية الواجبة متعددة ومنها الوصية بسداد الديون ووفاء النذور وقضاء ما فات من العبادات، إلا أن أهم أشكالها هو الوصية للأحفاد من قبل جدهم.
