يتعلق البحث بجريمة التنقيب غير المشروع عن الآثار ودراستها دراسة مقارنة بين الفقه الإسلامي والقانون الجزائري. وفي هذا إبراز لموقف الفقه الإسلامي من حماية الآثار, وبيان لمدى تقدم الجزائر في مجال حماية الموروث الثقافي وقياس مدى فعاليتها, خاصة بعد دسترة هذه الحماية لأول مرة في التعديل الدستوري لسنة 2016(المادة 45). وقد جاء البحث في أربعة فروع, تطرقت فيها على الترتيب إلى تحديد مصطلحات الدراسة, وموقف المعاصرين من التنقيب عن الآثار, ومدى شرعية ودستورية الحماية الجنائية للآثار, و أركان جريمة التنقيب غير المشروع عن الآثار, وأخيرا خاتمة ضمنتها بعض النتائج والتوصيات المستخلصة من الدراسة
