حاولنا في هذا الجزء من السلسلة أن نتحدث عما يمكن تسميته (ضوابط الحماية في الفقه الإسلامي) فكما ان هناك أولاداً يعيشون في أسر عادية، لهم أب يحميهم ويرعاهم، وأم تمدهم بحنانها وعطفها، وهم الأعم الغلب، لكن هناك أيضاً أولاد حرموا هذه الرعاية الأسرية بهذه الصفة، وصاروا محلاً لأن تختطفهم الأيادي الآثمة أو الشوارع المنحرفة، لذلك جاءت التشريعات الرحيمة الكثيرة لتسد هذه الخلة، وتردع القصور عن هذه الفئة المستضعفة، فتمدها بما يحميها من آثام الأيدي، وانحراف الشوارع، وقد حرصنا- بحسب القسمة العقلية، وبحسب استقراء الأحكام الشرعية- هذه الفئة المستضعفة التي تحتاج إلى حماية خاصة في ثلاثة أنواع: (اللقطاء، اليتامى، أبناء الأسر المنفصلة)، والذي دعانا إلى استعماله هو أن الفقهاء عادة يعبرون بهذا اللفظ عن كل مالا يصل إلى درجته المثالية، فيجعل الحنفية والمالكية مثلاً العلة في عدم تخيير المحضون- وهو من انفصل أبوه عن أمه- هي لقصور عقله الداعي إلى قصور اختياره، ولا يمنعنا من استعمال هذا المصطلح أنه يستعمل أحياناً كثيرة على الأولاد عموما، كما يستعمل مع كل الفئات المستضعفة، لأن تقييد الأولاد بكونهم قاصرين فيه هذه الدلالة الخاصة التي اشرنا إليها.
