بقدر ما يمتد سيف العدالة ظلاً وحماية للحاكم والمحكوم بقدر ما ينحسر الظلم فتبقى دائماً كلمة الحق هي العليا، والقضاء في حقيقته هو النظام الذي يصل به العدل إلى كل من اجترى على حق له وهو أيضاً القاضي الذي ينطق بالحق مجرداً عن الهوى آمناً على كلمته من أن ينالها الزيف أو التحريف حتى تصل إلى قهرالمتعدي، وآمناً على نفسه من أن يلحقه غدر من اقتص منه ومطمئناً على حاضره ومستقبله، وإذا كان مراد صاحب الحق أن ينال حقه بحكم من المحكمة فإن الهدف لن يتحقق ما لم يستطيع صاحب الحق أن يصل إلى حقه خاصة وقد تفشت ظاهرة جرائم تضليل العدالة وأصبح الناس في هذا الزمان أقرب للشروأبعد عن الخير، وكثرت الخصومات والمنازعات وتحايل الناس على الحق يبطلونه وعلى الباطل ينصرونه واتخذوا لذلك طرق شتى واساليب متعددة ومختلفة هذا ما دفعني إلى أن اكتب في موضوع (جريمة تضليل العدالة في الفقه الإسلامي والقانون الوضعي)، وقسمت البحث وجعلته في مقدة وفصل تمهيدي وبابين وخاتمة وقسمت البابين إلى فصول والفصول إلى مباحث والمباحث إلى مطالب حسب ما تقتضيه المادة العلمية لكل موضوع اما المقدمة فتشتمل على أهمية الموضوع وأسباب اختياري له، (وأما الفصل التمهيدي فيشتمل على تعريف الجريمة والجناية في الفقه الإسلامي والقانون الوضعي، ومقارنة بينهما، استعراض لمفهوم التضليل والعدالة، أما الباب الأول فموضوعه: جهات تضليل العدالة في نظر الفقه والقانون، أما الباب الثاني فموضوعه: صور لجرائم تضليل العدالة في الفقه الإسلامي والقانون الوضعي، والخاتمة تشتمل على أهم نتائج البحث والفهارس).
