ليس كل ما يتصل بتنظيم المرافق العامة ونشاطها يدخل في نطاق القانون الإداري واختصاص القضاء الإداري، بل يتعين أن تستخدم الإدارة وسائل القانون العام في مباشرة نشاط هذا المرفق وتنظيمه، بمعنى إن وجود المرفق العام وإن كان شرطاً ضرورياً لتطبيق قواعد القانون الإداري واختصاص القضاء الإداري، إلا أنه ليس بالشرط الكافي، ويجب أن يتبعه شرط آخر هو أن يدار هذا المرفق إدارة عامة وليس إدارة خاصة. فالإدارة يجب أن تستعين بوسائل القانون العام إذا أرادت أن يخضع عملها في ذلك للقانون الإداري والقضاء الإداري. أما إذا استعملت الإدارة وسائل القانون الخاص - في إدارتها للمرفق العام، فإنها تخضع على الفور للقانون الخاص والقضاء العادي، على الرغم من أن الأمر يتعلق بإدارة مرفق عام.
ومن هنا يتبدى بوضوح التداخل بين قواعد القانون العام وقواعد القانون الخاص، ولعل أوضح مثال لذلك يتمثل في التشريعات السياحية والفندقية، فبالرغم من أن هذه التشريعات تندرج ضمن قواعد القانون الإداري، حيث تتولى تنظيم مرفق السياحة ودور السلطة الإدارية في الإشراف والترخيص والمراقبة على إقامة وإنشاء المرافق السياحية والفندقية وتنظيم الشركات السياحية ومهنة الإرشاد السياحي، إلا أن معظم نشاط هذا المرفق يخضع للقانون الخاص باعتباره من المرافق الاقتصادية التي لا يصلح لإدارتها اتباع قواعد القانون الإداري وأحكامه.
وعلى ذلك نتناول في هذا المؤلف بالدراسة التشريعات المنظمة لصناعة الفنادق والمنشآت السياحية والإشراف على المناطق السياحية والإرشاد السياحي والشركات السياحية، على أن يسبق ذلك دراسة موجزة للقانون الإداري وذلك بتعريفه وبيان خصائصه ومصادره، وأوجه النشاط الإداري والتصرفات الإدارية.
