سنقوم في هذا البحث بدراسة الأصول العامة لولاية المظالم في الإسلام. ثم نتبعه بدراسة تطبيقية للنظام الموجود في المملكة العربية السعودية باعتبار أن المملكة وقد نشأت منذ بدايتها نشأة إسلامية عملت على إرساء قواعد العدالة بالنسبة للمواطنين كافة. واقتضى ذلك الاهتمام ولاية المظالم فقد جعل المغفور له الملك عبد العزيز بابه مفتوحاً لأصحاب المظالم وأن يضعوا شكاواهم في صندوق الشكايات المعلق على دار الحكومة واستمر خلفه على هذه السنة الحميدة. إلا أنه نتيجة للتطور الذي طرأ على وظيفة الدولة وتعدد مرافقها وكثرة أنشطها، وزيادة عدد العاملين بها. فقد اقتضى الأمر إنشاء جهة متخصصة للبحث في المظالم، وهذا ما تم في عام 1373 هجرية 1954 ميلادية حيث أنشيء ديوان المظالم كإدارة تابعة لمجلس الوزراء، ثم تطور الأمر وتحولت هذه الإدارة إلى جهاز مستقل يختص ببحث مشاكل الأفراد والعاملين ودراسة شكاواهم.
